29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system. On 9/6/2018, employees of Scott-Lee Guttering Company, were installing gutters on a residential building located at Lot 37 Carini Court, Saint Peters, MO 63376. Employees were approximately 10 feet above a lower level. Employees were not utilizing guardrail systems, a safety net system, or a personal fall arrest system. The employees were observed on the roof of the building without fall protection, exposing themselves to a fall to the ground below. Scott Lee Guttering Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1308841, citation number 1, item number 1 and was affirmed as a final order on 5/24/2018, with respect to a workplace located at 686 Mule Creek Drive, Wentzville, MO.
