29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means were taken to assure safe operation:     a. On or about April 16, 2018, the employer did not ensure insulation on piping 1954 A on or near Pressure Vessel VS 104 (-30 Recirculating Vessel) was repaired immediately to prevent access of water or water vapor in which is likely to break down the remaining insulation and cause corrosion on the internal piping. The employer did not ensure the integrity of the piping complied with an applicable recognized and generally acceptable good engineering practices (RAGAGEP) such as, but not limited to, IIAR Bulletin 110, 2002, Guidelines for: IIAR Minimum Safety Criteria for a Safe Ammonia Refrigeration System.    b. On or about April 16, 2018, the employer did not ensure that ammonia sensors located in area such as, but not limited to, the Evap 11/12, VRT Corridor, Pan Deck, 40 degree Room 2nd, and BR Line were replaced due to their end of useful life to ensure the detection of a potential ammonia release. The employer did not ensure sensors were operating in a manner to detect a potential ammonia release, which complied with applicable recognized and generally acceptable good engineering practices such as, but not limited to, the recommendations provided by CTI Calibration Technologies, Inc.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.119(m)(3): The incident investigation team did not consist of at least one person knowledgeable in the process involved, including a contract employee if the incident involved work of the contractor, and other persons with appropriate knowledge and experience to thoroughly investigate and analyze the incident:    a. On or about May 4, 2018, employees were exposed to inhalation hazards caused from an ammonia release inside and/or near Packing Line #2 and Barrel #3. The employer did not perform an adequate investigation of each incident, which would include assembling an incident investigation team with at least one person knowledgeable in the process.     b. On or about May 7, 2018, employees were exposed to inhalation hazards caused from an ammonia release inside and/or near the VRT Corridor, B&R Area, Packing Line #2, and Cooler Make-up/Ship Room. The employer did not perform an adequate investigation of each incident, which would include assembling an incident investigation team with at least one person knowledgeable in the process.    c. On or about May 24, 2018, employees were exposed to inhalation hazards caused from an ammonia release inside and/or near the B&R Freezer/Production Area. The employer did not perform an adequate investigation of each incident, which would include assembling an incident investigation team with at least one person knowledgeable in the process.    d. On or about May 25, 2018, employees were exposed to inhalation hazards caused by the exposure from an ammonia release inside and/or near the 2nd Floor (-40 Degree Room). The employer did not perform an adequate investigation of each incident, which would include assembling an incident investigation team with at least one person knowledgeable in the process    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

On or about May 4, 2018, employees were exposed to inhalation hazards caused by an ammonia release inside and/or near Packing Line #2 and Barrel #3. 29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:     On or about April 16, 2018, employees were potentially exposed to chemical burns caused by the corrosive chemical , anhydrous ammonia. Employees were required to conducting daily, weekly and monthly inspection that included preventative maintenance and repairs on the upper level of the engine room and the employer did not provided an emergency shower for quick drenching.      Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
