29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  a.  On or about April 18, 2018, at the South side of the residential building, an employee working on the soffit stepped on the top cap of a 6-foot Werner stepladder to access the wood made scaffold platform, exposing to a fall hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a.  Employees performing sheathing work on a 6:12 pitch residential roof are not being protected from fall hazards of 9 feet 7 inches, and up to 11 feet 4 inches, by the use of a fall protection system.  The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on, or about April 18, 2018, when employees were roof framing a one-story residence at 15 Jennie Lake Rd., Saint Augustine, Florida 32095 without a fall protection system and exposed to fall hazards of up to 11 feet 4 inches above the surrounding ground. 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:   a.  On or about April 18, 2018, at the South side of the residential building, one employee using a pneumatic nail gun to install wood for the soffit was not wearing eye protection and exposed to eye injuries by flying debris.   b.  On or about April 18, 2018, at the South side of the residential building, one employee using a circular saw to cut wood blocks for framing was not wearing eye protection and exposed to eye injuries by flying debris.   AJ New Construction and Repair, Inc. previously committed a serious violation of this standard on November 10, 2014, with respect to a workplace at 3805 Valverde Circle (Lot 7), Jacksonville, Florida which became a final order on January 26, 2015 (Inspection No. 1007334).
