29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: The employer did not administer a hearing conservation program for employees, who worked in the wooden pallet manufacturing area, and were exposed to noise that had exceeded an 8-hour TWA of 85 dBA, based on an 80 dB threshold: (a) A chop saw operator employee was exposed to continuous noise levels at 97.42% of the permissible 8-hour time weighted average (TWA) . The equivalent level of 97.42% is approximately 90.0 dBA. Sampling was performed for 322 minutes during one shift. Zero exposure was assumed for the 158 minutes not sampled; (b) A pallet dismantler employee was exposed to continuous noise levels at 238.9% of the permissible 8-hour time weighted average (TWA) . The equivalent level of 238.9% is approximately 96.2 dBA. Sampling was performed for 332 minutes during one shift. Zero exposure was assumed for the 148 minutes not sampled; (c) A pallet assembly employee was exposed to continuous noise levels at 111.8% of the permissible 8-hour time weighted average (TWA) . The equivalent level of 111.8% is approximately 91 dBA. Sampling was performed for 412 minutes during one shift. Zero exposure was assumed for the 68 minutes not sampled; (d) A pallet assembly employee was exposed to continuous noise levels at 111% of the permissible 8-hour time weighted average (TWA) . The equivalent level of 111% is approximately 91 dBA. Sampling was performed for 402 minutes during one shift. Zero exposure was assumed for the 78 minutes not sampled; (e) A pallet assembly employee was exposed to continuous noise levels at 261.9% of the permissible 8-hour time weighted average (TWA) . The equivalent level of 261.9% is approximately 97 dBA. Sampling was performed for 307 minutes during one shift. Zero exposure was assumed for the 173 minutes not sampled.
