29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: On or about April 23, 3018, employees were exposed to falls of approximately 5 feet 10 inches during the disassembly of racking systems in the warehouse and the employer did not fall protection was used.

29 CFR 1910.178(a)(4): Modifications and additions which affected capacity and safe operation were performed by the customer or user without manufacturers written approval, and the capacity, operation and maintenance instruction plates, tags or decals were not changed accordingly: On or about April 23, 3018, the employer failed to obtain the manufacturer's prior written approval before attaching the Ballymore cage used as a man lift to the Hyster forklift. The company also did not change the plates on the forklift to reflect the approval of the cage.
