Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees:    On or about April 20, 2018, the employer failed to ensure that the portable hand tools, including but not limited to the hand held circular saws, were inspected and in safe working order prior to allowing employees to use them in the workplace.  The employer does not provide the saws but allows the employees to bring in their own or purchase one through them.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    On or about April 20, 2018, the employer failed to ensure that employees who were voluntarily wearing tight fitting respirators with various cartridges underneath their welding hood were fit tested and medically cleared to wear the respirator.      NOTE:  The employer was previously cited for a violation of this occupational safety and health standard or it's equivalent standard which was contained in OSHA Inspection #11047395, citation 1, item 1, which was affirmed as final order on August 28, 2015, with respect to the workplace located at 14504 Commerce Street, Alliance OH 44601.
