29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):   a. At the site, employees were exposed to a 17 foot fall hazard while working form a tubular welded frame mobile scaffold three frames high, in that, the scaffold working platforms were not fully planked. Single plank metal platforms 19 inches wide were used to reach elevations during painting work, on or about 04/16/2018.

At the site, on or about 04/16/2018, employees were exposed to a 17 foot fall hazard, in that, employees involved in using a three frames high mobile scaffold were not provided training and education in the following:  1. The nature of fall hazards and any falling object hazards.  2. The correct procedures for dealing with erecting, maintaining, and disassembling the fall protection system and falling object protection system being used.  3. The proper use of the scaffold, and the proper handling of material on the scaffold.  4. The maximum intended load and load carrying capacities of the scaffold.  5. Any other pertinent requirements of Subpart "L" (Scaffolds) under 29 CFR 1926.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:   a. On or about 1:00 pm on 04/16/2018 at 10001 N Wickham Rd, Melbourne, Florida, an employee suffered a work related injury and was hospitalized for surgery on the same day of the injury. The employer was aware of the hospitalization on the same day of the incident. The employer notified OSHA on 04/18/2018 at 4:00 pm of the in-patient hospitalization.
