29 CFR  1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) At the Orange County Utilities' South Water Reclamation Facility, located at 4500 Sand Lake Rd. Orlando, Florida: On or about  January 29, 2021, the Employer failed to assess the exposure of an employee who was exposed to concentrations of respirable crystalline silica, above the permissible exposure level, of 8-hour TWA of 85.3 micro-gr/m3, 1.7 times above the permissible exposure level of 50.0 micro-gr/m3. The employer failed to perform any exposure assessment.  b) At the Orange County Utilities' South Water Reclamation Facility, located at 4500 Sand Lake Rd. Orlando, Florida: On or about  January 29, 2021, the Employer failed to assess the exposure of an employee who was exposed to concentrations of respirable crystalline silica,  above the action level, of  8-hour TWA of  45.4 micro-gr/m3, 1.8 times above the action level of 25.0 micro-gr/m3. The employer failed to perform any exposure assessment.

Orlando, Florida: On or about  January 29, 2021, an employee preparing the walls of Bay-A tank for lining application was expose to a 8-hour TWA of  85.3 micro-gr/m3 of respirable crystalline silica, 1.7 times above the permissible exposure level of 50.0 micro-gr/m3. The sampling was performed for  196 minutes on January 29, 2021. The employer did not make medical surveillance available to an employee that was or could be exposed to crystalline silica over the permissible exposure level.  b) At the Orange County Utilities' South Water Reclamation Facility, located at 4500 Sand Lake Rd. Orlando, Florida: On or about January 29, 2021,  an employee engaged in surface preparation operation was exposed to Respirable Crystalline Silica at a Time Weighted Average (TWA) of 85.3 micrograms per cubic meter (�g/m3), 1.7 times above the permissible exposure level of 50.0 micro-gr/m3. The sampling was performed for 196 minutes on January 29, 2021. The employer did not include employees performing surface preparation operations into the company respiratory protection program.  b)	At the Orange County Utilities' South Water Reclamation Facility, located at 4500 Sand Lake Rd.
