OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) No-Bake Department - on or about April 26, 2018, employees used a natural gas torch to ignite cores coated in a flammable liquid on the top surface of a combustible table.

29 CFR 1910.106(e)(2)(iv)(c): Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), were used where there were open flames or other sources of ignition within the possible path of vapor travel. a) No-Bake Department - on or about April 26, 2018, employees used Category 2 flammable liquids where there were open flames from a torch used to light cores on fire and were within the possible path of vapor travel.
