29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: A continuing, effective hearing conservation program was not administered for employees with the following exposures: a) Facility Workshop: An employee (Machinist) working on manual drills, was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Permissible Exposure Level). The employee's dosimeter level was 422.8% of the permissible level (90dBA) and was equivalent to approximately 100.4 dBA. The sampling was performed for 453 minutes during one shift on 7/12/2018. Zero exposure was assumed for all unsampled time periods. b) Facility Workshop: An employee (Machinist) working on the Mack 3 Router, was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Permissible Exposure Level). The employee's dosimeter level was 135.8% of the permissible level (90dBA) and was equivalent to approximately 91.9 dBA. The sampling was performed for 496 min during one shift on 7/12/2018. The exposure was adjusted to accommodate the additional time of exposure. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
