29 CFR 1910.147(d)(2): The machine or equipment was not turned off or shut down using the energy control procedures established for the machine or equipment:    a) Production Area, Mill Room-  On or about May 22, 2018 and at times prior, the employer exposed a temporary employee to an amputation hazard, in that, the employer failed to ensure that the authorized employee followed the established machine specific energy control procedure for mill #4 which was posted on the wall behind the mill beside the disconnect. The employee who had to partially enter the mill to clean the inside, including the mixing apparatus, did not lockout the mill at the disconnect switch and did not turn off the machine. The emergency stop had been engaged.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  a) Production Area, Mill Room- On or about May 22, 2018, and at times prior, the employer exposed an employee to an amputation hazard, in that the employer failed to provide lockout/tagout training to the (temporary) authorized employee to ensure that the employee acquired the knowledge and skills required for the safe application, usage and removal of energy control devices when cleaning equipment such as, but not limited to the powder mixing mill #4.

29 CFR 1910.146(c)(7)(i): A space classified by the employer as permit-required confined space was reclassified as a non-permit confined space when all hazards within the space were not eliminated without entry into the space:  (a) Production Area, Mill Room-  On or about May 22, 2018 and at times prior, the employer exposed an employee to an amputation hazard, in that, the employer failed to ensure that a temporary employee eliminated all hazards prior to entry by following the established machine specific lockout/tagout procedure for mill #4 which was the basis for reclassifying the mill from permit required to non-permit required.  The employee partially entered the mill to clean the inside, including the mixing apparatus and did not lockout the mill.

The employee partially entered mill #4 without eliminating all hazards prior to entry by following the established machine specific lockout/tagout procedures which was the basis for reclassifying the mill from permit required to non-permit required.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (a) Production Area, Mill Room- Employees exposed to dust while mixing raw ingredients (powders) and bagging finished products to produce decorative concrete coloring, were wearing filtering face piece type respirators (disposable dust masks) and were not given the information regarding the use and limitations of dust masks contained in Appendix D of the respirator standard. The dust masks were used on a voluntary basis.

Temporary employees mixed raw products and bagged finished products containing silica.
