29 CFR  1910.147(c)(6)(ii):  The employer's certification of periodic inspections did not identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection and/ or the person performing the inspection.  At a worksite located at 14201 Botts Rd, Grandview, Missouri. an examination of program elements determined that periodic inspections of energy control procedures were not accomplished and certified.  Specifically, reviews were not conducted to determine if listed steps were still adequate, if any changes had occurred, or if employees had acquired the knowledge needed to effectively isolate energy sources.

29 CFR  1910.147(c)(4)(ii):   The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29CFR 1910.147(c)(4)(ii)[A], 29CFR 1910.147(c)(4)(ii)[B], 29CFR 1910.147(c)(4)(ii)[C], and 29CFR 1910.147(c)(4)(ii)[D]:  At a worksite located at 14201 Botts Rd, Grandview, Missouri. Employees were exposed to serious amputation, crushing and struck-by injuries, in that the employer had not developed specific energy control procedures for the shutting down and return operations for the various types of machinery, including but not limited to the Kubota Brabender DDW-FW40MS5 FW40/5 Plus-50 ISC Hopper, Serial number W022308/7 known to the company as the Twin Screw hopper. , which had multiple energy sources including pneumatic and electrical.

29 CFR  1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:  (A)  Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. (B)  Each affected employee shall be instructed in the purpose and use of the energy control procedure. (C)  All other employees whose work operations are or may be in an area where energy control procedures may be utilized, shall be instructed about the procedure, and about the prohibition relating to attempts to restart or reenergize machines or equipment which are locked out or tagged out.  (A)  The employer did not provide training as required.  NOTE:  1910.147(c)(7)(iv) The employer shall certify that employee training has been accomplished and is being kept up to date. The certification shall contain each employee's name and dates of training.  At a worksite located at 14201 Botts Rd, Grandview, Missouri. Employees were exposed to serious amputation, crushing and struck-by injuries, employees authorized to perform lock out or tag out procedures were exposed to hazards because affected employees performing machine maintenance were not trained to understand the purpose of lockout provisions or program requirements. performing maintenance on the Kubota Brabender DDW-FW40MS5 FW40/5 Plus-50 ISC Hopper, Serial number W022308/7 known to the company as the Twin Screw hopper.
