29 CFR 1926.451(e)(9)(iv): The employer did not ensure that cross braces on tubular welded frame scaffolds were not used as a means of access or egress. On or about May 23, 2018, employees working on a commercial building were exposed to falls of approximately 16 feet (2nd tier) and 23 feet (3rd tier) of a welded scaffold. Employees used end frames as a means of access and egress.

29 CFR 1926.451(g)(1): The employer did not ensure that each employee on a scaffold more than 10 feet (3.1 m) above a lower level was protected from falling to that lower level. On or about May 23, 2018, employees working on a commercial building were exposed to falls of approximately 16 feet (2nd tier) and 23 feet (3rd tier) of a welded scaffold. Employees were not protected by adequate guardrail system or other form of fall protection. KOSA Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 975337, citation number 1, item number 1 and was affirmed as a final order on August 25, 2014, with respect to a workplace located at 5621 S. Broadway, Tyler, Texas 75703.
