OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed a fall and struck-by hazards:   a) Jobsite - On or about, and at times prior to May 21, 2018, employees standing on a 4 X 8 plywood attached to  a JLG 6042, Rough Terrain forklift were being elevated by the forklift order to transition onto the 5 and 12 pitch roof.  Employees were exposed to struck-by and fall hazards up to about 15 feet.

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:  a)  Jobsite - On or about May 21, 2018, while installing roof truss and 4 X 8 plywood decking the employer allowed employees to work from the exposed ceiling truss and top plate without fall protection, exposing employees to fall hazards up to 23-foot.

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely.  a) Jobsite - On or about, and at times prior to May 21, 2018, the employer was elevating employees using a JLG 6042 telehandler rough terrain forklift thereby exposing employees to a 15-foot fall  or struck by hazard.
