29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   a. On or about February 19, 2019, located at Building 12 at the Village at Central College, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the regulations applicable to framing work when employees were working from heights, operating nail guns, climbing ladders, working around equipment, etc., thereby exposing employees to fall, struck-by and caught-in/between hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   a. On or about February 19, 2019, located at Building 12 at the Village at Central College, an employee was standing on the second story wall top plate without any means of fall protection, thereby exposing the employee to a fall hazard of approximately 20 feet.      b. On or about February 19, 2019, located at Building 12 at the Village at Central College, employees were performing framing work on a residential home while not all windows had a top rail, thereby exposing the employees to a fall hazard of approximately 12 feet.      c. On or about February 19, 2019, located at Building 12 at the Village at Central College, employees were performing framing work on a residential home while there was a six foot by six foot floor hole behind the stairs exposing the employees to a fall hazard of approximately 10 feet.

29 CFR 1926.600(a)(3)(ii): Whenever the equipment is parked, the parking brake shall be set. Equipment parked on inclines shall have the wheels chocked and the parking brake set.   a. On or about February 19, 2019, located at Building 12 at the Village at Central College, a JCB 506-C rough-terrain forklift was used to lift building materials to the roof of a residential home. The forklift was parked on an incline without the wheels being chocked and with a 2 x 4 board used to hold pressure onto the forklifts brake due to the parking brake being inoperable, thereby exposing the employees to a struck-by and/or caught-between hazard if a runaway condition occurred with the forklift.

29 CFR 1926.602(c)(1)(vi): All industrial trucks in use shall meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.   a. On or about February 19, 2019, located at Building 12 at the Village at Central College, a JCB 506-C rough-terrain forklift was used to lift building materials to the roof of a residential home. The forklift was left unattended with the load elevated, thereby exposing the employees to a struck-by/caught-in hazard. The employer failed to comply with the requirements of operations under ANSI B56.1, which read, When leaving a powered industrial truck unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shut off, brakes set, key or connector plug removed. Block wheels if truck is parked on an incline.

29 CFR 1926.1051(b): Employers shall provide and install all stairway and ladder fall protection systems required by this subpart and shall comply with all other pertinent requirements of this subpart before employees begin the work that necessitates the installation and use of stairways, ladders, and their respective fall protection systems.  a. On or about February 19, 2019, located at Building 12 at the Village at Central College, employees used stairs to gain access to and from the second floor of a residential home. The employees had no fall protection system, i.e. guardrails on each side of the stairs exposing the employees to a maximum fall hazard of 16 feet.

29 CFR 1926.600(a)(5): All cab glass shall be safety glass, or equivalent, that introduces no visible distortion affecting the safe operation of any machine covered by this subpart.  a. On or about February 19, 2019, located at Building 12 at the Village at Central College, a JCB 506-C rough-terrain forklift was used to lift building materials to the roof of a residential home. The employer did not ensure that the forklifts cab glass was free of visible distortions as the right side window and left back window was cracked in several areas that could affect the safe operation of the forklift.
