OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by flying projectiles: Maintenance area: On or about May 23, 2018, employees were exposed to the hazard of being struck by flying projectiles, while operating compressed air tools such as blow-off guns and tire inflators. The compressed air used by the tools was transported above grade via 3/4" SCH 40 PVC JM Eagle Pipe.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) Throughout the work location: On or about May 23, 2018, and at time prior thereto, employees were exposed to struck-by hazards while operating a JLG, Model, ST9 forklift, S/N: 679451HRA, which had defective rear tires and a defective horn. b) Throughout the work location: On or about May 23, 2018, and at time prior thereto, employees were exposed to struck-by hazards while operating a Pro 5 forklift, S/N: 91, which had defective rear tires. c) Throughout the work location: On or about May 23, 2018, and at time prior thereto, employees were exposed to struck-by hazards while operating a Komatsu forklift, Model PG1851-16, S/N: 73, which had a missing seatbelt. d) Throughout the work location: On or about May 23, 2018, and at time prior thereto, employees were exposed to struck-by hazards while operating a JLG 6042 forklift, S/N: SA674157, which had a defective seatbelt and no back-up alarm. e) Throughout the work location: On or about May 23, 2018, and at time prior thereto, employees were exposed to struck-by hazards while operating a forklift, S/N: 72 which had a defective seat slide.

29 CFR 1910.305(b)(1)(ii): Unused openings in boxes, cabinets, or fittings were not effectively closed: Circuit panel next to air compressor: On or about May 23, 2018, and at times prior thereto, an employee was exposed to an electrical hazards while accessing a circuit breaker panel to switch on and off the air compressor. The circuit breaker panel was missing circuit breaker blanks, exposing 240 Vac energized bus bar.
