Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a forklift in the event of a tip over.     On or about May 21, 2018, and times prior thereto:     a.  An employee operated a Toyota Forklift ID #23 without utilizing a seatbelt.     b. An employee operated a Mitsubishi Forklift ID #492985 without utilizing a seatbelt.     c. An employee operated a Mitsubishi Forklift ID #739074 without utilizing a seatbelt.
