OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employees prepping railcars during elevated heat conditions were exposed to excessive heat: On or about June 1, 2018, at American Sugar Refining, Inc., the employer allowed employees to be exposed to excessive heat conditions while prepping and cleaning residual sugar from railcars in an outdoor environment. Among other methods, a feasible method to correct this violation includes but is not limited to: Provide mandatory training for all employees regarding the heat illness prevention program, the health effects associated with heat stress, recognizing symptoms of heat related illness, methods of preventing such illnesses, and the importance of employees reporting any symptoms of heat related illnesses to their supervisors.
