29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) East side of Building #3 - On or about June 7, 2018 employees reroofing the 3 story apartment building gained access to the roof 40 feet high using an aluminum extension ladder that did not extend 3 feet past the roofs edge and it was not tied off.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. EACH 1910 STANDARD USED MUST INCLUDE "AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)" at the end of the SAVE. (a) Building #3 & 4 - On or about June 7, 2018 an employee was operating 2 all-terrain forklifts to lift material to the top of the 3 story buildings without being trained and certified as an operator.
