29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  Pennsylvania - The employer did not certify that the citations had been abated within 10 days of the abatement date, on or about October 23, 2018.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user (Construction Reference 1926.103):  (a) Basement Level Garage - The employer permitted an employee to voluntarily wear a 3M 7502 elastomeric half-mask air-purifying respirator with 3M 6001 organic vapor cartridges when this employee used a roller to paint Sherwin-Williams Pro Industrial Pre-Catalyzed Waterbased Epoxy on the lower part of the garage walls.  The employer did not develop and implement any written respiratory protection program, exposing the employee to hazards of inhalation, ingestion, or absorption of contaminants and increased physiological burden, on or about June 7, 2018.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference: 1926.59):  (a) New Addition to U-Gro Learning Centre, Research Boulevard, Hummelstown, Pennsylvania - Employees used hazardous chemicals, including, but not limited to, Sherwin-Williams Pro Industrial Pre-Catalyzed Waterbased Epoxy, which classifies as a Category 1A carcinogen (due to the crystalline silica and cristobalite components) and a Category 2 reproductive toxicant (due to the 2-(2-Methoxyethoxy)-ethanol component), and the employer did not develop, implement, and maintain a written hazard communication program, on or about June 7, 2018.
