29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. On or about June 11, 2018, employees without protective helmets were working near the boom swing radius of an excavator that was operating near and under tree limbs. Employees were exposed to head injury from falling tree parts. There is no abatement certification or documentation required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c) or 29 CFR 1926.652(b). On or about June 11, 2018, employees were exposed to cave-in hazards as they worked in an excavation approximately 7.3 feet deep on the north face of the excavation and approximately 6.5 feet deep on the south face of the excavation without cave-in protection. Abatement documentation is required for this item in accordance with requirements of 29 CFR 1903.19(d).
