29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a)  Rip Saw operator feeding end:   On or about June 21, 2018 an employee was exposed to noise dose at levels of 135.3 % (equivalent to an 8 hour time weighted average TWA of 92.18 dBA) which is 2.71 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating the feeding end of the IMC Rip Saw. Results were calculated for a 468 minute sampling period.  The employer did not administer a continuing, effective hearing conservation program.    b)  Rip Saw operator receiving end:   On or about June 21, 2018 an employee was exposed to noise dose at levels of 88.5 % (equivalent to an 8 hour time weighted average TWA of 89.3 dBA) which is 1.77 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working in the packaging area sorting and grading bricks. Results were calculated for a 465 minute sampling period.  The employer did not administer a continuing, effective hearing conservation program.  c)  Moulder saw, end cut saw and resaw operator:   On or about June 21, 2018 an employee was exposed to noise dose at levels of 104.6 % (equivalent to an 8 hour time weighted average TWA of 90.3 dBA) which is 2.09 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating the moulder saw, end cut saw and resaw. Results were calculated for a 482 minute sampling period.  The employer did not administer a continuing, effective hearing conservation program.  d)  Moulder saw, end cut saw and resaw operator:   On or about June 21, 2018 an employee was exposed to noise dose at levels of 127.3 % (equivalent to an 8 hour time weighted average TWA of 91.7 dBA) which is 2.55 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating the moulder saw, end cut saw and resaw. Results were calculated for a 480 minute sampling period.  The employer did not administer a continuing, effective hearing conservation program.

29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared:     a)  Rip Saw operator feeding end:   On or about June 21, 2018 an employee was exposed to noise dose at levels of 135.3 % (equivalent to an 8 hour time weighted average TWA of 92.18 dBA) which is 2.71 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating the feeding end of the IMC Rip Saw. Results were calculated for a 468 minute sampling period. The employer did not institute a training program and ensure employee participation in the program:     a)  Rip Saw operator receiving end:   On or about June 21, 2018 an employee was exposed to noise dose at levels of 88.5 % (equivalent to an 8 hour time weighted average TWA of 89.3 dBA) which is 1.77 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working in the packaging area sorting and grading bricks. 29 CFR 1910.305(b)(1)(i): Openings through which conductors entered cutout boxes, cabinets, or fittings were not effectively closed:  a)    Employee bathroom: On or about June 21, 2018 and at times prior, the employer exposed employees to electrical burns, and shock hazards, in that a 110 volt light switch cover for outlet was not in place.
