29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including but not limited to the items in 1910.146(d)(3)(I) through 1910.146(d)(3)(vi):    On or about June 14, 2018, the employer did not ensure the permit required confined space program was implemented prior to employees entering the M-Tec MR 90 V Mixer. Employees are required to enter the mixer to clean out rocks by hand and did not properly deenergize the mixer prior to entry.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:      On or about June 14, 2018, the employer did not ensure each employee required to enter a permit required confined space was trained with the knowledge and skills necessary to safely perform entry of a permit required confined space. Employees were not trained in required permit documentation measures or the proper deenergization procedures prior to removing mortar rocks from the M-Tec MR 90 V mixer. Employees are exposed to caught by and crush hazards from the rotating mixer arm.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:    On or about June 20, 2018, the employer did not assure periodic audits of the energy control procedures were completed at least annually. Employees are required to perform cleaning activities on machines including but not limited to, the M-Tec MR 90 V mixer, which require energy control procedures that have not been reviewed for deficiencies.

Employees were required to perform activities such as cleaning out rocks from the M-Tec MR 90 V cement mixer, and are exposed to amputation hazards from moving parts in that the equipment was not properly deenergized.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):     On June 14, 2018, employees were exposed to amputation injuries in that the M-Tec MR 90 V mixer was not properly deenergized prior performing cleaning activities. An employee received a partial arm degloving injury while attempting to clean out rocks from inside the mixer. The employer did not ensure that energy control application steps to control the electrical and residual rotational energy sources were implemented prior to maintenance tasks the employer did not:  �  Physically operate energy isolating devices to control energy sources and affix lockout device(s).  �  Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe.  �  Verify that isolation and deenergization of the machine or equipment had been accomplished.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:      On or about June 20, 2018, employees were exposed to amputation and crushing hazards when performing cleaning activities inside the M-Tec MR 90 V mixer on the mezzanine in the Mortars Plant. The employer did not ensure energy control procedures were documented and utilized to properly control the residual energy of the rotating mixer before entering the mixer.        Sika Corporation was previously cited for a violation of this occupational safety and health standard 1910.147(c)(4)(I), which was contained in OSHA inspection number 1057374 citation number 1, item number 1 and was affirmed as a final order on 11/6/15 with respect to a workplace located at 100 Dan Rd. Canton, MA 02021.
