29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Swift Beef Company at 800 N. 8th Ave, CO: On and before June 21, 2018, the employer did not develop, implement or maintain at the workplace a site specific written hazard communication program which describes the criteria for Globally Harmonized System labels. Employees were potentially exposed to hazardous chemicals, including but not limited to the following: 1) Ammonia 2) Carbon Dioxide 3) Purac CL 21/80 4) PC-622 5) Calcium Hypochlorite 6) Marking Ink Purple 7) Hydrogen Sulfide 8) KC-615

29 CFR 1910.1200(f)(6): The employer used written materials, such as signs, placards, process sheets, or batch tickets in lieu of affixing labels to individual stationary process containers that failed to identify the container(s) to which they were applicable and did not convey the information required by 29 CFR 1910.1200(f)(5): (a) Swift Beef Company at 800 N. 8th Ave, CO: On and before June 21, 2018, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemicals contained within. The employer did not ensure that the Globally Harmonized System was implemented for the labelling of chemical containers at the establishment and was still using National Fire Protection Association labels. Two chemical containers of KC-615 at two boot foam disinfection stations around the slaughter floor did not have labels. A secondary chemical container of Purac CL 21/80 at the lactic acid mixing area in the fabrication area did not have a label. A defaced chemical container of Marking Ink Purple in the slaughter area had a National Fire Protection Association label. This condition exposed employees to chemical hazards, including but not limited to the following Purac CL 21/80, Marking Ink Purple and KC-615.

29 CFR 1910.1200(g)(8): The employer did not ensure that Safety Data Sheets were readily accessible during each work shift to employees when they were in their work area(s): (a) Swift Beef Company at 800 N. 8th Ave, CO: On and before June 21, 2018, the employer did ensure that Safety Data Sheets were readily accessible during each work shift to employees when they were in the fabrication, slaughter, and rendering areas. The employer maintained physical and electronic copies of Safety Data Sheets but the Safety Data Sheets were only available by request from a manager with the exception of Purac CL 21/80 for which a physical copy of the Safety Data Sheet was readily accessible to employees at the lactic acid mixing area around the fabrication floor. Employees were potentially exposed to hazardous chemicals, including but not limited to the following ammonia, carbon dioxide, PC-622, calcium hypochlorite, Marking Ink Purple and KC-615.
