29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a) Roof - Employees were observed using pneumatic nail guns to attach shingles to the roof and did not don safety glasses and were exposed to ricochet nails and flying debris, on or about June 22, 2018. No abatement certification or documentation required.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Roof - Employees were observed without fall protection while conducting roofing operations on a steep roof and were exposed to fall hazards up to 35 feet - 7 inches to the ground below, on or about June 22, 2018. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. Daniel F. Smith Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1080601, citation number 1, item number 1 and was affirmed as a final order on December 17, 2015, with respect to a workplace located at 81 Main Street, McSherrytown PA 17344.
