29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On June 27, 2018 at 1752 Steiner Lane in Howard, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazard associated with employees working from the top of a foundation wall, the top of I-joists, and at the edge of floor decking without adequate fall protection systems.

29 CFR 1926.502(k)(1): The fall protection plan shall be prepared by a qualified person and developed specifically for the site where the leading edge work, precast concrete work, or residential construction work is being performed and the plan must be maintained up to date. On June 27, 2018 at 1752 Steiner Lane in Howard, the company fall protection Abatement Plan did not conform to the required provisions; employees were exposed to nine and one half feet fall hazards during leading edge work while working from the top of a foundation wall, the top of I-joists, and at the edge of floor decking without utilizing conventional fall protection equipment. In the written plan, the specific site location was not identified; no reasons were included explaining why conventional fall protection is infeasible during installation of the first row of decking and for work at the leading edge; no instruction provided to identify the controlled access zone. The Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.502(k)(1), which was contained in OSHA inspection number 1110565, citation number 01, item number 001 and was affirmed as a final order on March 3, 2016, with respect to a workplace located at 2728 S. Promenade Cir.; Sheboygan, WI 53081.
