29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): The employer does not ensure that employees are protected from falls to lower levels. This most recently occurred on August 28, 2019 when an employee installing trusses was exposed to a fall while working at a height more than 13 feet above the lower level (interior flooring). To abate this violation, the employer must ensure that employees are protected from the hazard of falling more than 6 feet to a lower level through the use of fall protection. This employer has been previously cited for this practice that included: Steve Fischer Construction, LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1288303, citation number 2, item number 1 and was affirmed as a final order on June 4, 2018, with respect to a workplace located at Cottontail Lane, Building #3, Reedsburg, WI 53959. To abate this violation, the employer must ensure that employees do not use the top or top step of stepladders.
