29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale or, equivalently, a dose of fifty percent: (a) An employee engaged in welding activities was exposed to a recorded personal noise dosimeter sound level of 88.43 decibels time-weighted average which was 1.622 times over the action level during 425 minutes sampling on August 15, 2018 in that a hearing conservation program was not established. (b) An employee engaged in welding activities was exposed to a recorded personal noise dosimeter sound level of 88.48 decibels time-weighted average which was 1.610 times over the action level during 402 minutes sampling on August 15, 2018 in that a hearing conservation program was not established.

29 CFR 1910.95(g)(6): Annual audiogram. At least annually after obtaining the baseline audiogram, the employer shall obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels: (a) An employee engaged in welding activities was exposed to a recorded personal noise dosimeter sound level of 88.43 decibels time-weighted average which was 1.622 times over the action level during 425 minutes sampling on August 15, 2018 in that audiometric test was not provided annually. (b) An employee engaged in welding activities was exposed to a recorded personal noise dosimeter sound level of 88.48 decibels time-weighted average which was 1.610 times over the action level during 402 minutes sampling on August 15, 2018 in that audiometric test was not provided annually.
