29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale or, equivalently, a dose of fifty percent:    (a) An employee engaged in welding activities was exposed to a recorded personal noise dosimeter sound level of  88.43 decibels time-weighted average which was 1.622 times over the action level during 425 minutes sampling on August 15, 2018 in that a hearing conservation program was not established.    (b) An employee engaged in welding activities was exposed to a recorded personal noise dosimeter sound level of 88.48 decibels time-weighted average which was 1.610 times over the action level during 402 minutes sampling on August 15, 2018 in that a hearing conservation program was not established.
