29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a. On or about June 29,2018 employees had used an aluminum articulating ladder to gain access to the roof and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, and a grasping device was not provided to assist employees in mounting and dismounting the ladder.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  a. On or about June 29, 2018 Employees were stripping the roof of an existing one story dwelling and were not protected by any means of personal fall Protection, guardrails or safety nets exposing them to falls in excess of 9 feet to the ground below.  Employees state they were all trained in the need for and use of fall protection, and were provided with personal fall protection harnesses but claimed the roof was not steep enough to require fall protection, leading CSHO to believe they did not retain or understand the training that was provided.
