29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    On July 9, 2018, located on the roadway of Wooster Pike, Cincinnati OH, an employee was inside a 6'-9" deep excavation preparing to install a catch basin that had not been trained on the applicable procedures or regulation to minimize those hazards such as cave-in protection associated with trenching and excavation.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.    On July 9, 2018, located on the roadway of Wooster Pike, Cincinnati OH, employees were preparing to install a catch basin inside an excavation at a depth of  approximately 6'-9", as standing water was present and protective measures and/or water removal methods were not utilized to protect employees against the hazards posed by water accumulation.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.    On July 9, 2018, located on the roadway of Wooster Pike, Cincinnati OH, inspections of the excavation by a competent person were not conducted in that employees were working in the bottom of an excavation without adequate sidewall protection. Excavation depth measured to be 6'-9".     The Tri-State Concrete Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1), which was contained in OSHA inspection number 977185, citation number 1, item number 1 and was affirmed as a final order on 7/08/2014, with respect to a workplace located at 7748 Hosbrook Rd., Cincinnati, OH 45243.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On July 9, 2018, located on the roadway of Wooster Pike, Cincinnati OH, employees were exposed to cave-in hazards while working in a 6'-9" deep excavation without the use of adequate protective systems.     The Tri-State Concrete Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 977185, citation number 1, item number 2 and was affirmed as a final order on 7/08/2014, with respect to a workplace located at 7748 Hosbrook Rd., Cincinnati, OH 45243.
