29 CFR 1926.20(b)(1): The employer did not initiate and maintain programs necessary to ensure compliance with the Occupational Safety and Health Standards:        Employee(s) engaged in framing work using pneumatic nailers, ladders, powered tools, and etc. at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to hazards such as struck by and fall hazards in that the employer had not developed nor implemented safety and health programs that provide construction hazard recognition guidelines to mitigate those hazards.

29 CFR 1926.405(g)(2)(iii): Hard service flexible cords No. 12 or larger were repaired when spliced without the splice retaining the insulation, outer sheath properties, and usage characteristics of the cord that was spliced:  Employee(s) engaged in using a 100 foot extension cord to power a Dewalt power saw that was used to cut lumbar on the east side of the job site located at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to electrical hazards due to the repair made on the spliced extension cord did not retain the insulation and outer sheath properties of the original extension cord.  The spliced area exposed approximately 4 inches of inner conductors.

(b) Employee(s) engaged in using a Makita power saw to cut lumbar inside Townhouse C located at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to electrical hazards due to the receiving end of the extension cord being frayed exposing approximately 1/2 inches of inner conductors.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501:  (a) Employees engaged in framing a residential four-plex building located at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to a fall hazard of approximately 11 feet due to no fall protection system being provided in Townhouse A. The employee was setting trusses on the east side of Townhouse A.  (b) Employees engaged in framing a residential four-plex building located at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to a fall hazard of approximately 9 feet due to no fall protection system being provided in Townhouse A. The employees were framing the lower level of Townhouse A next to an open stairway that was approximately 4 feet wide by 9 feet long.  (c) Employees engaged in framing a residential four-plex building located at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to a fall hazard of approximately 9 feet due to no fall protection system being provided in Townhouse B. The employee was erecting a scaffold on the north side of townhouse B next to an open stairway that was approximately 4 feet wide by 9 feet long.  (d) Employees engaged in framing a residential four-plex building located at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to a fall hazard of approximately 9 feet due to no fall protection system being provided in Townhouse C. The employee was standing on floor joist preparing to frame the next level of the building on the northeast side of Townhouse C.  (e) Employees engaged in framing a residential four-plex building located at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to a fall hazard of approximately 9 feet due to no fall protection system being provided in Townhouse C. The employees were framing the lower level of Townhouse C next to an open stairway that was approximately 4 feet wide by 9 feet long.  (f) Employees engaged in framing a residential four-plex building located at 23921 W. 66th Street, Lot 19, Shawnee, Kansas were exposed to a fall hazard of approximately 9 feet due to no fall protection system being provided in Townhouse D. The employees were framing the lower level of Townhouse D next to an open stairway that was approximately 4 feet wide by 9 feet long.  The D and D Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1302067, citation number 1, item number 2 and was affirmed as a final order on June 19, 2018, with respect to a workplace located at 4721 NE Pocono Circle, Lot 39, Lees Summit, Missouri.
