29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.     a) On or about August 9, 2018, Continental Carbonic Products, did not utilize methods such as but not limited to barrier guards that would prevent employee's exposure to the blade of vertical band saw. Employees, utilizing the vertical band saw, were exposed to a cut by hazard in that 5 inches of the non working portions of the blade were not enclosed or guarded.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):    a) On or about August 9, 2018, Continental Carbonic Products, did not ensure feasible administrative or engineering controls were determined and implemented, to reduce employee exposures to carbon dioxide on the production floor. Employees were exposed to carbon dioxide at levels 280%, and 200% of the permissible exposure limit.        Step3: Abatement shall have been completed by the implementation of feasible engineering and/or administrative controls upon verification of their effectiveness in achieving compliance.       Feasible engineering controls include, but are not limited to:    1) Installation of local exhaust ventilation for the extruder and block machines.  2) Installation of additional general ventilation.

29 CFR 1910.134(c)(1): Where respirators were necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures.     a) On or about August 9, 2018, Continental Carbonic Products, did not provide each employee a respirator when it was necessary to protect the health of the employees from carbon dioxide exposures levels in excess of the Permissible Exposure Limit (PEL) during periods necessary to install or implement feasible engineering and work practice controls. Employees were exposed to carbon dioxide at 280% and 200% of the permissible exposure limit.      Step 1: Provide effective respiratory protection to and ensure it is used by exposed employees as an interim protective measure until feasible engineering and/or administrative controls can be implemented or whenever such controls fail to reduce employee exposure to within permissible exposure limits.

29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of carbon dioxide listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 5000 parts per million (ppm):    a) On or about August 9, 2018, Continental Carbonic Products, Inc. did not ensure that employees were not exposed to carbon dioxide in excess of the Permissible Exposure limit (PEL) as an 8-hour Time Weighted Average (TWA). An employee working on the Block Line was exposed to a TWA of carbon dioxide of 14,000 ppm, which exceeded the PEL of 5,000 ppm by 280%.     b) On or about August 9, 2018, Continental Carbonic Products, Inc. did not ensure that employees were not exposed to carbon dioxide in excess of the Permissible Exposure limit (PEL) as an 8-hour Time Weighted Average (TWA). An employee working on the production floor was exposed to a TWA of carbon dioxide of 10,000 ppm, which exceeded the PEL of 5,000 ppm by 200%.    Step 2: A written detailed plan of abatement shall be submitted to the Area Director outlining a schedule for the implementation of engineering and/or administrative measures to control employee exposures to hazardous substances as referenced in this citation.  This plan shall include, at a minimum, target dates for the following actions which must be consistent with the abatement dates required by this citation:      (1)   Evaluation of engineering /administrative control options;  (2)   Selection of optimum control methods and completion of design;  (3)   Procurement, installation and operation of selected control measures;  (4)   Testing and acceptance or modification/redesign .      All proposed control measures shall be approved for each particular use by a competent industrial hygienist or other technically qualified person.
