29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. a) Facility - There was no site specific written respirator program for employees that were required to wear tight fitting respirators including, but not limited to 2300N95 negative pressure half mask air purifying respirators, when applying ACE premium Enamel and Rust-Oleu spray paint. On or about 6/6/18. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. a) Facility - Employees required to wear tight fitting respirators including, but not limited to 2300N95 negative pressure half mask purifying respirators when applying insulation ACE premium Enamel and Rust-Oleu spray paint were not medically evaluated prior to the wearing of the respirators. On or about 6/6/18. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
