OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a tip over/crushing hazard due to the possibility of overloading the JLG 400S Telescopic Aerial Boom Lift and causing it to tip over. a. On or about July 12, 2018 - at the above addressed jobsite, a JLG 400S Telescopic Aerial Boom Lift was used to hoist a steel beam using a cable wire sling which was affixed to the bottom of the basket. An employee was exposed to hazards associated with overloading and failure of the lift.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. a. On or about July 12, 2018, at the above addressed jobsite, an employee operating a JLG telescopic boom aerial lift, approximately eight(8') feet above the ground, was not wearing personal fall protection, thereby exposing the employee to falls.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. a. On or about July 12, 2018, at the above addressed jobsite, an employee conducting welding operations was exposed to a fall of twenty (20') feet. Schmidt Steel Incorporated was previously cited for a violation of this Occupational Safety and Health Standard 1926.760(a)(1), which was contained in OSHA inspection number 1236807, citation number 1, item number 1 and was affirmed as a final order on July 06, 2017, with respect to a workplace located at 236 S. Racine Ave, Chicago, IL 60607. Schmidt Steel Incorporated was previously cited for a violation of this Occupational Safety and Health Standard 1926.760(a)(1), which was contained in OSHA inspection number 957944, citation number 1, item number 1 and was affirmed as a final order on April 15, 2014, with respect to a workplace located at 25777 Cleveland Ave., Monee, IL 60449.
