On or before July 13, 2018, the employer failed to initiate and maintain health and safety program such as but not limited to a fall protection program, thereby exposing employees to fall hazards of 12 feet. b. On or before July 13, 2018, the employer failed to initiate and maintain health and safety program such as but not limited to a ladder safety program, thereby exposing employees to fall hazards of 12 feet.  c. On or before July 13, 2018, the employer failed to initiate and maintain health and safety program such as but not limited to a scaffold safety program, thereby exposing employees to fall hazards of 16 feet.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   a. On or before July 13, 2018, where an employee used an extension ladder to gain access to the porch roof, the ladder did not extend at least 3 feet above the porch roof, thereby exposing the employee to a 12 foot fall hazard.

29 CFR 1926.451(c)(2)(i): Footings shall be level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement.  a. On or before July 13, 2018, where employees were installing siding from a pump jack scaffold, the footings were not placed on a level, sound, rigid surface that was capable of adequately supporting the loaded scaffold, thereby exposing employees to a 16 foot fall hazard.  Josue Diaz Anariba Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1194791, citation number 1, item number 1 and was affirmed as a final order on February 27, 2017, with respect to a workplace located at 1059 Tree Line Way, Delaware, OH 43015.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.   a. On or before July 13, 2018, where employees were installing siding from a pump jack scaffold, the employees were not protected from falls by the use of a net that extended the entire length of the platforms of the scaffold, thereby exposing employees to a 16 foot fall hazard.   b. On or before July 13, 2018, where employees were installing siding from a pump jack scaffold, the employees were not protected from falls by the use of end railing on the platforms of the scaffold, thereby exposing employees to a 16 foot fall hazard.  Josue Diaz Anariba Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1194791, citation number 1, item number 2a and was affirmed as a final order on February 27, 2017, with respect to a workplace located at 1059 Tree Line Way, Delaware, OH 43015.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or before July 13, 2018, where an employee was working from the garage roof, the employee was not protected from falls, thereby being exposed to a 12 foot fall hazard.  b. On or before July 13, 2018, where an employee was working from the porch roof, the employee was not protected from falls, thereby being exposed to a 12 foot fall hazard.
