29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: Site- The employer did not have a competent person conduct an inspection of an excavation at the intersection of Mascoma Street and High Street prior to employees entering and working from the excavation which had vertical sides between 7 and 9 feet deep and did not have adequate cave in protection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). Site- Employees working from the open end of a trench box placed directly against a vertical excavation wall, approximately 9 deep at the intersection of Mascoma Street and High Street, were not protected from a cave-in hazard. Park Construction Corp was previously cited for a repeat violation of this occupational safety and health standard which was contained in OSHA inspection number 1140111, citation number 2, item number 1b and was affirmed as a final order on June 3, 2016 with respect to a workplace located at 2125-2143 Elm Street, Manchester, NH 03111. Park Construction Corp was previously cited for a serious violation of this occupational safety and health standard which was contained in OSHA inspection number 1052949, citation number 1, item number 1c and was affirmed as a final order on July 9, 2015 with respect to a workplace located at Kosciuszko Street, Manchester, NH 03105.

29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: Site- Employees working from an excavation with vertical sides and between approximately 9 and 7 feet deep at the intersection of Mascoma Street and High Street were not protected from a cave-in hazard where the ladder used to access excavation was placed approximately 10 feet from the end of the trench box inside the excavation. Park Construction Corp was previously cited for a serious violation of this occupational safety and health standard which was contained in OSHA inspection number 1052949, citation number 1, item number 2 and was affirmed as a final order on July 9, 2015 with respect to a workplace located at Kosciuszko Street, Manchester, NH 03105.
