29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a)Kroon Home Improvement dba Kroon Roofing at 1800 88th Street, Sioux Falls, SD 57108: On or about and at times prior to July 17, 2018, the exposing employer did not ensure that each employee engaged in roofing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees engaged in roofing activities worked near the edge of a two story, a 7-in-12 pitch roof on a residential home without the use of a fall protection system. This condition exposed employees to a fall in excess of 9 feet. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: a) The nature of fall hazards in the work area; b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; d) The role of each employee in the safety monitoring system when this system is used; e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g) The role of employees in fall protection plans; h) The standards contained in this subpart. Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.

This condition exposed the employees to a fall hazard of 9 feet. Abatement Note: The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable: (a) The nature of fall hazards in the work area; (b) The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used; (c) The proper construction, use, placement, and care in handling of all stairways and ladders; (d) The maximum intended load-carrying capacities of ladders; and (e) The standards contained in this subpart.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a)Kroon Home Improvement dba Kroon Roofing at 1800 88th Street, Sioux Falls, SD 57108: On or about and at times prior to July 17, 2018, the exposing employer did not ensure fall protection systems were utilized for employees working on a roof. Two employees were installing ice and water shield near the edge of a 7-in-12 pitched roof on a single-family home and were not using a fall protection system. This condition exposed employees to a 9-foot fall hazard. Kroon Roofing was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 988068, Citation Number 1, Item 1, issued on August 6, 2014, and became Final Order on August 27, 2014, with respect to a workplace located at 6315 Crane Avenue, Sioux Falls, SD 57104.
