29 CFR 1926.20(b)(2): The employer did not ensure a safety program was in place to provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer: (a)Kroon Home Improvement at 4615 South Louise Avenue, Sioux Falls, SD 57106: On or about and at times prior to October 24, 2019, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Two employees were exposed to a fall hazard while re-roofing a single family home without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 16 feet at the eave and 23 feet at the rake edge. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: (a)Kroon Home Improvement dba Kroon Roofing at 4615 South Louise Avenue, Sioux Falls, SD 57106: On or about and at times prior to October 24, 2019, the exposing employer did not ensure employees were protected from fall hazards by use of an appropriate fall protection system. Employees were engaged in re-roofing activities on a single-family home without the use of a fall protection system. This condition exposed three employees to a fall hazard of approximately 16 feet at the eave and 23 feet at the rake edge to the ground below. Kroon Home Improvement was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1331241, citation number 2, item number 1 and was affirmed as a final order on August 27, 2019, with respect to a workplace located at 1800 88th Street, Sioux Falls, SD 57106. Kroon Roofing, LLC was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 988068, Citation Number 1, Item 1, issued on August 6, 2014, and became Final Order on August 27, 2014, with respect to a workplace located at 6315 Crane Avenue, Sioux Falls, SD 57104.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a)Kroon Home Improvement dba Kroon Roofing at 4615 South Louise Avenue, Sioux Falls, SD 57108: On or about and at times prior to October 24, 2019 the controlling employer did not ensure that each employee engaged in roofing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees engaged in roofing activities worked near the edge of a split level home with a 4/12 pitch roof without the use of a fall protection system. This condition exposed three employees to a fall in excess of 16 feet. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: a) The nature of fall hazards in the work area; b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; d) The role of each employee in the safety monitoring system when this system is used; e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g) The role of employees in fall protection plans; h) The standards contained in this subpart. Kroon Home Improvement was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1331241, citation number 1, item number 1 and was affirmed as a final order on August 27, 2019, with respect to a workplace located at 1800 88th Street, Sioux Falls, SD 57106.
