29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system. On 6/21/2018, employees of D & W Construction LLC, were working on the roof of a residential building located at Lot 1 3rd Street/Halifax Street, Moscow Mills, MO. An employee were engaged in roofing work approximately 18 feet above a lower level. Employees were not utilizing guardrail systems, a safety net system, or a personal fall arrest system. The employee was observed on the roof of the building without fall protection, exposing themselves to a fall to the ground below.
