29 CFR 1910.141(a)(4)(ii): All sweepings, solid or liquid wastes, refuse and garbage was not removed in such a manner as to avoid creating a menace to health and as often as necessary or appropriate to maintain the place of employment in a sanitary condition.      Assembly Room;    On or about 7/23/18, hand brushes and a shop vac were used to clean metal dusts, created during filing, from the work stations, which causes it to become airborne. The metals filed in this area included beryllium copper, brass and aluminum. Dry sweeping is not sufficient to remove the fine metal dust and can make it airborne. Wipe samples indicated the presence of copper, zinc oxide and cadmium, which is a carcinogen.

29 CFR 1910.141(g)(2): Employees were permitted to consume food or beverage in area(s) exposed to toxic materials:    Assembly Area;    On or about 7/23/18, employees who filed metal parts for assembly, consumed beverages from open containers at their work stations. The metals filed included beryllium copper and brass. Wipe samples indicated that there was cadmium, copper and zinc oxide dust on the surfaces.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):      Assembly Area and Machine Shop;    On or about 7/23/18, the employer did not develop and implement a hazard communication program for the metals that are machined and filed to assemble into tally counters. The metals include beryllium copper and brass. Wipe samples indicated cadmium, chromium, iron oxide, nickel, zinc oxide, vanadium and copper dust to be present on the work surfaces. Cadmium is a carcinogen.
