NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) J Fithian Tatem Elementary School at 1 Glover Ave, in Haddonfield, NJ, 08033, on the first, second, and third floor of the school outside facing on the South side of the structure: Employees operated a DeWalt angle grinder (28115, serial number 038182) to cut the masonry exterior of the J. Fithian School for restoration purposes with a DeWalt tuck pointing shroud (DWE46100) and dust collection system (Hilti VC 150-6 XE, serial number 016918) which was not an integrated system per the manufacturer's instructions and did not meet the requirements as an engineering control required by Table 1 , (ii) Handheld power saw; which occurred on or about 7/26/18. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
