29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    On Aug. 8, 2018, an employee was operating a ARDCO/Traverse TL6035 Telescopic Forklift that had not received training required by this subpart.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On Aug. 2, 2018, there were no frequent and regular inspections being performed by a competent person in that:    (a) employees were working from a tubular welded frame scaffold platform at fall heights greater than 13 feet above the next lower level without a fall protection system     (b) employees were working from a tubular welded frame scaffold platform with long platforms, that overlapped the support posts by more than 12 inches at several platform locations, that were not nailed together or otherwise restrained to prevent movement    (c) employees working from a tubular welded frame scaffold platform had planks installed at a right angle, where the platform changed direction at two corners, that were not laid first so that the right angle planks were underneath the scaffold platform planks and thereby restrained to prevent movement     (d) employees working from a tubular welded frame scaffold platform were using a portable extension ladder for access that did not extend 3 feet above the upper landing surface    (e) employees working from a tubular welded frame scaffold platform were mixing mortar at a mud bucket, on the upper level platform, within 5 feet of an unguarded scaffold platform section that did not have any guardrails installed

The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  29 CFR 1926.454(a)(3): The proper use of the scaffold, and the proper handling of materials on the scaffold;    On Aug. 2, 2018, employees were performing work from a tubular welded frame scaffold that had not received training to recognize the hazards associated with the type of scaffold being used, and to understand the procedures to control or minimize those hazards. Potential fall heights were measured to be greater than 13 feet above the next lower level while not utilizing a fall protection system.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer did not provide a training program for employees that were observed performing work from a tubular welded frame scaffold while not utilizing a fall protection system and exposed to fall heights greater than 13 feet above the ground below.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    On Aug. 2, 2018, located throughout a commercial structure, employees were working from several areas of an upper level platform of a tubular welded frame scaffold that did not have guardrails installed while not utilizing a fall protection system. Potential fall heights were measured to be greater than 13 feet above the ground below.
