29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On March 5, 2020, located on a commercial roof, employees exposed to a fall hazard while standing on a mezzanine deck installing capstones on top of a parapet wall while not utilizing any fall protection system. Potential fall height measured to be greater than 25 feet.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. On March 5, 2020, located on a commercial roof, the employer failed to install a fall protection system before employees installing capstones on top of a parapet while standing on a mezzanine deck. Potential fall height measured to be greater than 25 feet.
