29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  On or about August 3, 2018, an employee from Andre Tuckpointing & Brickwork was exposed to a struck-by hazard as he was not wearing a protective helmet while performing masonry activities on the ground directly below the tuckpointers working on the ladder jack scaffold.

29CFR1926.404(f)(6): The path to ground from circuits, equipment and enclosures were not permanent and continuous:  Employees from Andre Tuckpointing & Brickwork were exposed to an electrical hazard as they were tuckpointing a residence located at 4972 Botanical Avenue, St. Louis, Missouri.  At the job site, the path to ground from circuits was not permanent and continuous when workers used electrical flexible cords with missing ground pins to power portable hand grinders to remove brick mortar.

29 CFR 1926.451(e)(1):  When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used. Support ladders were used as a means of access.  On August 3, 2018, employees from Andre Tuckpointing & Brickwork were tuckpointing the side of a residential building located at 4972 Botanical Avenue, St. Louis, Missouri.  At the job site, employees were exposed to a fall hazard as they were not provided with safe access to the ladder jack scaffold located on the east facing side of the building.  The two employees had to climb over the outward facing ladder jack brackets to access the scaffold plank positioned approximately 12 feet, 8 inches above ground.

The employer failed to have the scaffold inspected by a competent person.  The employees were working from a ladder jack scaffold system which was approximately 12 feet, 8 inches above the ground without personal fall arrest systems (PFAS) and no safe means of access had been installed.

At the job site, the ladder jack scaffold system was not erected, moved, and altered by trained and experienced employees under the supervision and direction of a competent person.  The employees were working from a ladder jack scaffold system which was approximately 12 feet, 8 inches above the ground without personal fall arrest systems (PFAS) and no safe means of access had been installed.

The employees were working from a ladder jack scaffold system approximately 12 feet, 8 inches above the ground without personal fall arrest system (PFAS) equipment.
