29 CFR 1910.28(b)(3)(ii): The employer did not ensure each employee is protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems: a) Spray Dryer Room No. 2 - On or about September 13, 2018, employees were required to enter into the Spray Dryer Chamber to perform cleaning. The concrete walkway floor leading up to the Spray Dryer Chamber's manway entry door had a floor hole measuring 5.5 inches in its least dimension, which increased up to 12 inches around the diameter of the Spray Dryer, and was 47 inches above the lower level. The employer failed to ensure each employee was protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Spray Dryer Room No. 2 - On or about July 28, 2018, employees were required to service and maintain machines including, but not limited to, the Spray Dryer No. 2, Sifter/Screens, Liquid Mixers, and the Spray Dryer Chamber. The employer failed to develop and implement a program consisting of an energy control procedures, employee training and periodic inspections to ensure that the machines shall be isolated from their energy source(s) and rendered inoperative during servicing and maintenance. Employees were thereby exposed to the hazards associated with moving parts and/or rotating parts.
