29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a)Orellana Construction, Inc. at 502 East Kemp Avenue, Watertown, SD 57201:  On or about and at times prior to August 9, 2018, the exposing employer did not ensure that each employee was protected from impact or falling objects from the roof of a single-family home by means of a protective helmet. Employees were exposed to falling tools and materials while working on the ground during re-roofing operations without a protective helmet.  This condition exposed employees to struck-by hazards.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)Orellana Construction, Inc. at 502 East Kemp Avenue, Watertown, SD 57201:  On or about and at times prior to August 9, 2018, the exposing employer did not ensure employee that were installing roofing materials with the use of a pneumatic nail gun were protected from flying objects by the use of appropriate eye protection. This condition exposed employees to struck-by hazards.

This condition exposed employees to a fall hazards between 11 feet and 25 feet on the rake edge of the roof near the peak.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)Orellana Construction, Inc. at 502 East Kemp Avenue, Watertown, SD 57201:  On or about and at times prior to August 9, 2018 the exposing employer did not ensure that each employee engaged in re-roofing operations on a single-family home, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevations between 11 feet and 25 feet on the rake edge of the roof near the peak.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Orellana Construction, Inc. at 502 East Kemp Avenue, Watertown, SD 57201:  On or about and at times prior to August 9, 2018, the exposing employer did not ensure that each employee was protected from falls from ladders in that nine employees were utilizing ladders to gain access to the roof that were not extended at least three feet above the upper landing surface. This condition exposed employees to fall hazards.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The condition exposed employees to the hazard of falling from an elevation of approximately 11 feet.
