29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Orellana Construction, Inc. dba Integrital Edge, Inc. at 5000 North Harvestore Road, Sioux Falls, SD 57107:  On or about and at times prior to August 25, 2025, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting various construction operations on a commercial property to include inadequate fall protection systems, ladder hazards, and a lack of proper training to recognize ladder deficiencies or other fall hazards.  This condition exposed employees to fall and struck-by hazards.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  (a)Orellana Construction, Inc. dba Integrital Edge, Inc. at 5000 North Harvestore Road, Sioux Falls, SD 57107:  On or about and at times prior to August 25, 2025, the employer did not ensure a written training certification on the use of fall protection systems prior to employees being exposed to fall hazards while working on a commercial property. This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladders side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Orellana Construction, Inc. dba Integrital Edge, Inc. at 5000 North Harvestore Road, Sioux Falls, SD 57107:  On or about and at times prior to August 25, 2025, the employer did not ensure that the Werner 20-foot aluminum extension ladder, Model Number: DI220-2, Part Number: 53496-01 Rev C 8/04 DLS that employees were using was extended at least three feet above the upper landing surface of the south roof eave of a commercial structure.  This condition exposed employees to fall hazards.

This condition exposed employees to fall hazards.

29 CFR  1926.501(b)(10): Employees engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:   (a)Orellana Construction, Inc. dba Integrital Edge, Inc. at 5000 North Harvestore Road, Sioux Falls, SD 57107:  On or about and at times prior to August 25, 2025, the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a low slope commercial property. This condition exposed the employees to fall hazards greater than six feet.  Orellana Construction, Inc. dba Integrital Edge, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1664071, citation number 1, item number 1 and was affirmed as a final order on August 14, 2023, with respect to a workplace located at 6045 A1A South, Saint Augustine, FL 32080.
