Such activities were not performed only by experienced and trained employees selected for such work by the competent person. (a) The employer did not ensure a scaffold system was dismantled under the supervision of a competent person. Company personnel were in the process of dismantling a scaffold section when an employee inadvertently fell off the scaffold causing an impalement injury.

Retraining is required in at least the following situations: a) The employer did not ensure protruding pieces of reinforcing steel onto which an employee could fall was guarded to ensure employees are not exposed to impalement hazards.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. (a) The employer did not ensure that platform units were installed so no gap greater than 1 inch was present. In certain areas of a supported scaffold, there were gaps greater than 1 inch between scaffold planks and planks and uprights. Craft Masonry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(b)(1), which was contained in OSHA inspection number 1090906, citation number 01, item number 03 and was affirmed as a final order on January 2, 2016, with respect to a workplace location at 41st St. and Greenfield Ave., Milwaukee, WI 53208.
