29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety: (a) On or about August 8, 2018 for the employees exposed to cave-in hazards while connecting water pipes in the trench approximately 10.5 feet deep without protective systems on the south wall at or near 4801 37th Avenue NW in Mandan, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1151072, Citation 1, Item 1a, and was affirmed as a final order on 10/17/2016, with respect to a workplace located in the vicinity of 43rd Avenue & Normandy Street in Bismarck, North Dakota.

Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1151072, Citation 2, Item 1, and was affirmed as a final order on 10/17/2016, with respect to a workplace located in the vicinity of 43rd Avenue & Normandy Street in Bismarck, North Dakota.
