29 CFR 1910.178(p)(1): A powered industrial truck was in need of repair, defective, or was unsafe and the truck was not taken out of service until it had been restored to safe operating condition: 241 B Bliss St, West Springfield, MA On or before August 15, 2018, three of eight powered industrial trucks were found to have inoperative emergency brakes and employees were operating the three trucks to move pallets and load trailers.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, and/or were placed in service when the examination showed condition adversely affecting the safety of the vehicle. Such examination was not made at least daily. Where industrial trucks are used on a round-the-clock basis, they were not examined after each shift. Defects when found were not immediately reported and corrected. 241 B Bliss St, West Springfield, MA On August 15, 2018 and for at least two days prior, industrial trucks were not effectively examined to discover conditions adversely affecting the safety of the vehicle. On August 15, 2018, three powered industrial trucks were in use and found to have inoperative emergency brakes.
